Terms of Use

These Terms of Use ("Terms") govern your access to and use of FlySMS (the "Service"). By creating an account, purchasing or using any virtual numbers, SMS, OTP or related services, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility and Account

You represent and warrant that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

2. Nature of the Service

The Service provides access to virtual phone numbers and related messaging services for receiving SMS, verification codes and similar communications from third‑party platforms and applications. The Service is intended solely for lawful purposes and legitimate account verification, testing or communication use cases.

The Service does not provide traditional telephony, emergency calling or guaranteed delivery of any messages. We rely on external telecommunications infrastructure, aggregators and other upstream providers to deliver SMS and related traffic. As a result, we do not control, and are not responsible for, delays, failures or errors caused by networks, carriers or third‑party platforms.

3. No Affiliation With Third‑Party Platforms

Any use of the Service with third‑party applications (for example messaging apps, social networks, e‑commerce platforms, payment providers or email providers) is solely between you and those third parties. We are not endorsed by, affiliated with, or officially connected to any such platform. Each platform may have its own terms, policies and restrictions. You are solely responsible for ensuring that your use of the Service complies with all applicable third‑party terms and policies.

4. Acceptable Use

You agree not to use the Service, and not to allow anyone else to use the Service, for any unlawful, harmful, abusive, deceptive or otherwise improper purpose, including without limitation:

  • Creating or using accounts in violation of another service's terms or policies;
  • Sending or receiving spam, unsolicited messages or fraudulent communications;
  • Engaging in phishing, social engineering, impersonation or identity theft;
  • Bypassing or attempting to bypass platform security, verification or anti‑abuse mechanisms;
  • Engaging in, promoting or facilitating money laundering, terrorism, scams or other criminal activity;
  • Infringing the intellectual property, privacy or other rights of any person; or
  • Interfering with or disrupting the integrity or performance of the Service or any related systems.

We may suspend or terminate your access immediately, without refund, if we reasonably believe that you have violated these Acceptable Use obligations or applicable law.

5. Availability, Quality and Limitations

The Service is provided on an "as‑is" and "as‑available" basis. We do not guarantee that any particular number, operator, country, price, route or verification flow will be available at any time. Numbers may be recycled, blocked or rejected by third‑party platforms at their sole discretion.

SMS delivery times and success rates depend on carriers, networks and third‑party platforms outside our control. We do not warrant that messages will be delivered, that verification codes will be accepted, or that you will be able to successfully create or keep any account with any third‑party service.

6. Payments, Credits and Refunds

You may be required to pre‑fund your wallet or pay in advance for services. All prices, fees and billing units are shown in the currency indicated in the interface and may change at any time. Unless we state otherwise in writing, all purchases are final and non‑refundable once a number has been allocated, an order has been created or credits have been applied to your account.

We may, at our sole discretion, issue goodwill credits or partial refunds in specific cases (for example when there is a clear technical issue on our side), but we are under no obligation to do so. You are solely responsible for choosing the correct service, country, operator and price tier before confirming a purchase.

7. Compliance, KYC and Fraud Prevention

We may implement risk checks, anti‑fraud measures, usage monitoring and, where required by law or by our providers, know‑your‑customer (KYC) procedures. You agree to cooperate with any reasonable requests for information and acknowledge that failure to do so may result in suspension or termination of your account and loss of access to remaining credits, without refund.

8. Intellectual Property

All rights, title and interest in and to the Service, including but not limited to software, interfaces, designs, text, graphics, logos and trademarks (excluding third‑party logos and marks, which remain the property of their respective owners), are owned by us or our licensors. You receive a limited, revocable, non‑exclusive, non‑transferable license to access and use the Service strictly in accordance with these Terms.

9. Disclaimers

To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express, implied or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, non‑infringement, quiet enjoyment, accuracy or reliability. We do not warrant that the Service will be uninterrupted, error‑free, secure or free from harmful components, or that any defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, punitive or exemplary damages of any kind, including without limitation loss of profits, loss of data, loss of business, loss of goodwill or the cost of substitute services, arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any and all claims arising out of or related to the Service or these Terms will not exceed, in the aggregate, the amount you paid to us for the Service during the three (3) months immediately preceding the event giving rise to the claim, or one hundred (100) units of your billing currency, whichever is lower.

11. Indemnification

You agree to indemnify, defend and hold harmless us and our owners, directors, employees, partners and service providers from and against any and all claims, demands, losses, liabilities, damages, costs and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service; (b) your violation of these Terms or of any applicable law or regulation; or (c) your violation of any third‑party rights.

12. Suspension and Termination

We may suspend or terminate your access to the Service, in whole or in part, at any time and for any reasonable reason, including without limitation suspected abuse, fraud, non‑payment, excessive chargebacks, or requests from law enforcement or other authorities. Upon termination, your right to use the Service will immediately cease, and any remaining credits may be forfeited, unless required otherwise by law.

13. Changes to the Service and Terms

We may modify or discontinue any part of the Service at any time, with or without prior notice. We may also update these Terms from time to time. When we do, we will change the "Last updated" date above and, where required by law, provide additional notice. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws applicable in the jurisdiction where we are established, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of that jurisdiction, unless mandatory law requires otherwise.
